Vietnam's regulatory framework for civil cryptography has entered a new stage following the issuance of Decree No. 341/2026/ND-CP.

Issued by the Government of Vietnam on September 1, 2026, Decree 341/2026/ND-CP provides detailed regulations and implementation measures under the Law on Cybersecurity concerning civil cryptography activities. The Decree took effect on the same day it was issued.

For manufacturers, technology companies, distributors and importers bringing encryption-enabled products into Vietnam, this is an important regulatory development to understand.

It is also an area where practical import and compliance experience matters.

On 16th October 2025, Tron Chan Co., Ltd. was invited to participate and contribute practical perspectives at a conference in Ho Chi Minh City discussing the implementation of new legal regulations on civil cryptography activities.

The conference provided an opportunity for regulators, technical organizations and businesses to exchange views on the practical implementation of Vietnam's evolving civil cryptography regulations.

What is Civil Cryptography in Vietnam?

Under Decree 341/2026/ND-CP, civil cryptography products include hardware, software, documents, technical equipment and cryptographic operations used to protect information that does not fall within the scope of state secrets. The Decree also regulates civil cryptography services, including services involving information protection, product assessment and cybersecurity consulting using civil cryptography products.

This definition is particularly relevant to international technology companies because cryptographic functions are increasingly embedded into ordinary IT and network equipment.

Encryption may be found in products such as:

  • Network security equipment;

  • VPN and secure communication devices;

  • Encryption and key-management systems;

  • Hardware security products;

  • Secure storage devices;

  • Software and security solutions incorporating cryptographic functions; and

  • Other technology products that may fall within Vietnam's civil cryptography regulatory framework.

As a result, determining whether a product is subject to Vietnam's civil cryptography regulations may require more than simply looking at the product's commercial name.

The technical specifications, cryptographic functionality and applicable regulatory classification may all need to be considered.

Decree 341/2026/ND-CP: What Has Changed?

One of the most important aspects of Decree 341/2026/ND-CP is that it provides a more detailed framework for the management of civil cryptography products and services, including import and export activities.

The Decree covers conditions for conducting business in civil cryptography products and services, as well as the authority, documentation and procedures relating to licenses for importing and exporting civil cryptography products.

For companies planning to import civil cryptography products into Vietnam, several areas deserve particular attention.

1. Product classification

The first question is often whether a particular product falls within the scope of civil cryptography regulations.

This can become complicated when a product has multiple functions. For example, a network device may perform routing, firewall, VPN, authentication and encryption functions simultaneously. The regulatory treatment may therefore depend on the actual technical characteristics of the product rather than its marketing name alone.

2. Import licensing requirements

Decree 341/2026/ND-CP provides a framework for licenses relating to the import and export of civil cryptography products.

The Decree also establishes a list of civil cryptography products subject to import/export licensing. According to the Government's explanation, the list applies where the HS code, product description and cryptographic technical characteristics correspond to the relevant entries in the list.

This makes accurate product information particularly important during the import planning stage.

3. Technical standards and conformity requirements

Compliance does not necessarily end with obtaining an import license.

Decree 341/2026/ND-CP also provides that civil cryptography products must be inspected and certified for conformity before being circulated on the market in applicable cases.

This is one reason why importers should evaluate technical and conformity requirements before shipping the product to Vietnam, rather than waiting until the goods arrive at customs.

4. Dual-use products require careful review

Modern ICT products increasingly combine several security functions.

A product may therefore have both civil cryptography and cybersecurity features.

Under the new framework, certain dual-use products involving civil cryptography and cybersecurity may fall under the licensing authority of the Ministry of Public Security, with consultation from the Government Cipher Committee regarding the product's civil cryptography functions.

For international manufacturers, this reinforces the importance of reviewing the product's actual technical configuration and functions before determining the import procedure.

Tron Chan Shares Practical Industry Perspectives

At the conference, Tron Chan focused its discussion on the practical situation surrounding the development and application of national standards and national technical regulations for civil cryptography.

While Vietnam has made progress in developing its technical regulatory framework, businesses continue to face practical challenges, including:

  • Testing time and costs;

  • Conformity assessment and certification procedures;

  • Capacity of conformity assessment organizations;

  • The need to keep technical standards up to date with rapidly developing technology; and

  • Practical challenges faced by companies introducing international technology products into the Vietnamese market.

From a business perspective, Tron Chan highlighted the importance of continuing to improve Vietnam's technical standards and conformity assessment system, strengthening testing capacity and considering appropriate mechanisms for recognizing conformity assessment results from qualified foreign organizations.

These issues are particularly relevant to international manufacturers and technology companies looking to import civil cryptography products into Vietnam.

Importing Civil Cryptography Products into Vietnam with Decree 341/2026/ND-CP: Why Early Compliance Review Matters

For an overseas manufacturer, importing a technology product into Vietnam is not simply a matter of arranging transportation and customs clearance.

The regulatory assessment should ideally begin before the shipment is prepared.

Depending on the product, an importer may need to consider the following working flow:

Product Compliance Flow
Product Compliance Flow

A mistake at an early stage can create delays later in the import process.

For example, relying only on an HS code without reviewing the product's cryptographic functions may not provide sufficient information to determine the applicable regulatory requirements.

Similarly, waiting until goods have arrived in Vietnam before checking licensing or conformity requirements can result in unnecessary costs and operational delays.

How Tron Chan Supports Civil Cryptography Product Imports

With experience in Vietnam's import and trade-compliance environment, Tron Chan works with international businesses that need to bring specialized technology products into Vietnam.

Our role can extend beyond conventional customs clearance.

For civil cryptography-related products, the process may involve:

  • Reviewing product specifications and technical documentation;

  • Identifying potential regulatory requirements;

  • Supporting import compliance planning;

  • Coordinating import licensing and relevant documentation where applicable;

  • Handling customs clearance;

  • Supporting Importer of Record (IOR) arrangements where appropriate; and

  • Coordinating with relevant parties throughout the import process.

The objective is simple: identify regulatory issues before the shipment moves, rather than trying to resolve them after the goods arrive.

This approach is particularly important for international companies that do not yet have a local operational structure in Vietnam.

Staying Ahead of Vietnam's Civil Cryptography Regulations

Decree 341/2026/ND-CP marks an important development in Vietnam's regulatory framework for civil cryptography.

For manufacturers, distributors and technology companies, the key take away is that civil cryptography compliance should be considered as part of the product import strategy, not as a separate issue after the shipment has already been arranged.

As Vietnam continues to develop its cybersecurity and cryptography regulatory framework, companies entering the market will need to keep track of changes in licensing, product classification, technical standards and conformity requirements.

Tron Chan will continue to monitor these developments and share practical insights for international businesses operating in Vietnam.
